Geraldo Says State Is Using Dirty Tricks and Damning Evidence in Anthony Case

Geraldo Rivera’s show on May 31, 2009 featured attorneys for Casey Anthony. Linda Kinney-Baden, in New York, and Jose Baez, from Florida, answered questions and discussed the latest motion filed by Baez regarding the video of Casey Anthony in the medical unit at the Orange County Jail on December 10, 2008 when the remains of a child were found near her home.

Geraldo started out stating “Prosecutors have become twisted in their relentless pursuit of her life.” He went on to say he believed this is an “unprecedented move for a case of this sort.” Stating that he thought “Casey is most probably responsible for her daughter’s death,” Geraldo said the State is using every “dirty trick in the book,” including “manipulating witnesses.” He further stated the prosecutors are “leaking damning videotape and every deposition they can get their hands on.” This was his lead into the real issue of this segment with Anthony’s attorneys; the filming of Ms. Anthony’s reactions. Geraldo said Casey was maneuvered into the medical wing of the jail so “they could videotape her reaction to finding remains.”

Geraldo questioned Baez on his opinion as to whether he believed he will be successful in keeping this video from being released. Jose Baez stated he is using the “mode to keep video sealed” via a “suppression motion.” He went on to state that he “was at the jail trying to see Casey and was prevented from seeing her while they conducted this sham job.” Geraldo interjected with, “They denied her her right to counsel.” Geraldo stated he spoke with Baez the morning the remains were found and after Baez visited Casey that day.

Baez told Geraldo he was told he could not see Casey “until she was taken to medical and cleared.” Baez stated that he waited a lengthy period of time before he was allowed to visit his client while she was in medical. He said, “She thought she was being taken for medical treatment.” Geraldo’s comment was, “It seems so cheap with them releasing interviews.”

Geraldo then turned to Linda Kinney-Baden for her views on where the defense stands on the issue of the videotape. Ms. Baden stated that, “interviews were accidentially released” which “taints jury pool.” Ms. Baden further stated that as per media reports, “she (Casey) has no privacy rights.” Baden was emphatic in stating it’s untrue that inmates have no privacy rights. She seemed angered about the fact that while taping, someone “zoomed in on her (Casey) face while talking with her attorney and presented that as evidence that they were going to set out to the public.” Baden called this “outrageous.”

Geraldo’s legal analyst stated Casey’s contact with her attorney is “protective communications” and it’s “unethical” to tape. Her opinion was this “calls into question about the evidence in the case,” and the “Prosecutor must abide by the Constitution and uphold a person’s rights.”

Geraldo asked Baez to give his thoughts on the state charging Casey Anthony with Capital Murder. Baez stated he “does not think this is a death penalty case,” but “they (the prosecution) are aggressive with their public relations prosecution.” Due to the State’s tactics on this case, Jose Baez said they are, “mounting a strong defense and fight for her life.” Geraldo ended this segment with, “they are treating her as a serial murderer. I think it’s appalling.”

While viewing the episode I was literally enraged. That is exactly the reaction this show seeks. After viewing this segment all I could initially think of was Geraldo’s stinging remarks and how animated Baden seemed. I watched the video of this segment a couple of times and regained my rational perspective. Geraldo’s introduction and presentation of the facts were in his usual sensationalistic, showy mannerism. He started the segment with his typical firey pattern of using brusque words; accusing the State of “dirty tricks, manipulating witnesses, and leaking damning videotape.”

Geraldo made sure he inserted the fact that he spoke with Jose Baez that very day Caylee’s remains were found, not only once but twice. This comment seemed out of context with the subject Geraldo set in which Baez was responding. What did Geraldo having spoken with Baez twice that day by phone have to do with the defense’s attempts to suppress a videotape? Nothing. In my opinion, this was Geraldo’s attempt to validate to viewers his close involvement with the case and Jose Baez. Geraldo must feel important to be closely associated with Jose Baez, the up and coming Hispanic attorney battling the vicious media and Caucasion State Prosecutor. My remarks regarding his comment is about as important in this blog article as Geraldo’s remark that he spoke with Baez that day. It leads no where.

What I did find particularly amusing was that Geraldo actually stated that Casey was most probably guilty of killing her daughter. Neither Baden nor Baez commented on this statement. I would think since Geraldo is such good friends with Jose Baez, he would refrain from making such a damning remark regarding the defendent. Equally puzzling is the fact that Baez did not take Geraldo to task on this, which leads me to wonder if this is a subject Geraldo and Baez discussed in their ongoing conversations on this case. Maybe Baez revealed something to Geraldo which caused him to pronounce this judgement.  One thing was clear to me in watching this segment…Geraldo’s snappy remarks were not on target with the subject.

Baden made one statement presenting a new fact. She stated “they zoomed in on her (Casey) face while she was talking with her attorney.” Baden indicated corrections officers were attempting to watch Casey’s lips in order to determine what she was possibly saying about the remains. So, in other words, this videotape might provide a lip reader with closeup views of Casey. If this is true that Casey’s face was zoomed on while she spoke with Baez then I agree, her right to privacy was violated. Since I’ve not seen this video, I cannot state this for certain. We, as the public, are left with the interpretation of her defense attorneys. The Prosecutor is not going to give her interpretation of the taping, so until a judge has reviewed the video and gives his official determination, we don’t know what is really on that tape.

In summary, Baez did not say anything new in his responses to Geraldo. Casey’s rights were discussed. As always, she has a right to speak confidentially with her lawyer, and she has a right for her medical treatment to remain confidential. Also, Baez continued to complain the Prosecution is trying this case in the public, and he reiterated he was not allowed to see his client when she asked to see him.

In my opinion, Geraldo was doing a favor for his friend, Baez. The defense wanted an opportunity to air their position on this videotape, so Baez took it to the one news show, if you can call it that, he trusted. Too bad Baez wasn’t listening closely when Geraldo said Casey most probably killed her daughter. Comments such as this could taint the jury pool. Hopefully, not many Floridians were watching. Baez cannot point the finger at the prosecution for this blunder. Perhaps Geraldo thought his last statement regarding Casey being treated as a “serial murderer” would make up for his previous condemnation of her.  Still, Geraldo’s remarks were off target and dramatic to “beef up” the story and inflame the audience.

This four minute segment on the Casey Anthony case obviously was intended for the show’s ratings, but with an underlying purpose to give air time to the defense team. Baden and Baez presented their case views through this media outlet, of their choice, which is exactly what they’ve accused of the State of Florida District Attorney’s Office. Oddly, the Prosecution nor law enforcement has appeared on any shows discussing their case against Casey. The Defense team needs to call a spade a spade. They are up against the Sunshine laws, and now Geraldo’s damning statement and melodramatic  journalism.

    What is so ridiculous about this is why would the state want to video tape casey’s reaction as Baez claims to put her in a bad light to the reaction of the remains found when the State or no one else at this point knew it was caylee’s remains? Geraldo is just an idiot as usual. It is no wonder he is good friends with bozo Baez.

    Bozo Baez by making such a fuss over this casey tape has actualy just confirmed to everyone that his client Casey knew it was caylee’s remains from having this reaction before it was even identified as being caylee’s remains. shows clearly since casey reacted this way she already knew it was caylee and the only one that could have known this at this point is the murderer. Thank you bozo Baez.

    Thank you for your comments. I am amazed that Baez did not address Geraldo’s statement that Casey is most probably responsible for her daughter’s death. That said to me, either, Baez & Baden were not paying attention, or, it’s something Baez & Geraldo spoke of and Geraldo just can’t keep his mouth shut. He’s so much about boasting and feeding a frenzy.

    shadowing crime, my guess the reason Baez nor Baden did not address Geraldo stating casey probably responsible for Caylee’s death is they are all idiots for one, two Baez nor Baden either one want to go there, as they know their client is guilty as sin. Great topic by the way.

    Looks like Casey will walk on the first-degree charge. The proseution should not have screwed up the case, but too bad for them. I hope they post the names and addresses of all the prosecution by the end of this case.

    michellefrommadison, way too soon to be judging the prosecution’s case let alone if the defense will be able to prove reasonable doubt….sure wouldn’t be laughing or bragging if you are in the anthony camp just yet! If you only care about Casey at this point all one can do with wish you strength to hang in there and be able to accept what ever comes.

    Interesting words… Justice, stagnant….but not very accurate IMO

    where is your proof of violations. Just because someone you like said so! So far we’ve only heard spins without any substance from the defense which appears to be their standard tactic.

    Again I wish you strength as you struggle to support those you care for……..myself I care only for justice for the true victim in these type of cases; who no longer can confront the person responsible for their demise.

    The defense’s job is not about justice for a victim, not about whether a suspect is truly guilty of the crime or not. The simple truth is a child died and someone is responsible regardless of the conditions leading up to the event. Twisting the facts to hide the guilt to whatever extent is not justice. Justice isn’t blind…..

    Loving a child regardless of the evil or mistakes they have made is being a parent but condoning their actions is blind. Someone once said, “I love you but I hate what you do.”

    I don’t think the state has messed up the case. LE is allowed to use trickery to get the answers they need. The tape may not be released to the public but that will have no bearing on the case. The transcripts show they took Casey by the TV and videotaped her. They didn’t have to tell her what was on the TV because she knew exactly where they were located. She didn’t flinch when LP was looking for the body in the Econ River. Her actions when seeing the location says it all.

    The defense is going to play dirty and will pull every trick to try and discredit any evidence.

    Why is Baez still doing talk shows? Didn’t he file a motion for a change of venue due to publicity? Stay off tv you idiot or you won’t get that change of venue!!!! By the way all the stuff released by the prosecution isn’t sneaky it is called FLORIDA SUNSHINE LAW, the prosecutors are doing their JOBS!!!! Some people just don’t get it, I think Jose could be hit with a ton of bricks and he would still not get it, he is the only blabber mouth.

      Laura, Baez does want a change of venue due to the media coverage, but it’s okay if he issues statements. I agree with you, if Baez doesn’t want media coverage, he needs to stay off the TV shows, but in this case, his efforts to bring his case back on track failed miserably. He talked with the wrong commentator.

    Sometimes I forget what a jerk Geraldo is and I watch his show. Well, now I am convinced that he must be related to Baez – why else would he put his own credibility on the line. I would love to wipe that smug look off Baez’ face. Doesn’t he know he’ll go down in history and not in a good way.

    You know that Larry King Live’s ratings dropped by 57% the night he interviewed the Anthonys, right? I doubt if he’ll ever have them on again. I think we should seriously start pulling support from any product sponsoring these shows that are “contaminating the jury pool” with their lies.

    It takes some work to get all the sponsors names and then to email each of them to say you will not buy their product ever again if the product is used to create a pro-Anthony spin. Does anybody else have the energy to do this? Or is it better to just give them as much rope as they need in order to hang themselves.

    The Larry King show has asked Cindy and George Anthony to return to his show to discuss the cases against Casey and the lawsuits that will be filed by their and other attorneys against the County, media and bloggers.     There has been and continues to be substantial and substantive circumstantial and forensic evidence that points directly at Casey Anthony as the only person of interest in the death of her child. In her own words she was the last person to see Caylee alive and the only person who drove the automobile with the remains of the victim in the trunk. She was the only one familiar with the crime scene -she lived there.
    On Dec 11, 2008 the remains were found and identified to be Caylee Marie Anthony. Evidence found at the final resting place were items which matched up with those found at her home nearby.
    Casey Anthony never called LE to report her child missing. She was never missing. She was dead.

    From here on out it will be the lawyers talking about the purity and virtue of their client and how others behavior is “cruel and unusual”.
    I regret that Casey did not plead out and accept Life. If she is convicted and found guilty she spends her Life sentence on Death Row and that means 23 hours a day in isolation. Everyone knows she will never receive the death penalty and therefore to incarcerate her in this way for Life is, imo very cruel and very unnecessary.

      If you believe news reports, Baez would not allow her to plea. IMO, he has convinced Casey he can get her off on these charges. Has he forgotten the check charges? She’ll get extensive prison time for those charges.

    I read somewhere that George and Cindy are being investigated under federal RICO laws -they knew Caylee was dead, but continued to solicit cash to look for a live Caylee. That’s racketeering, if the feds can prove it. And interesting if true.

    RICO law:

    If a person commits two certain offenses in 10 years, RICO charges will follow. Two of those certain offenses happen to be fraud and obstruction of justice.

    I only hope the people in Florida pursue legal action against the Anthony’s.

    Located in the CNN Transcript sections, fourth-page, right-side link, there is a statement by Larry King indicating that he agrees with Geraldo and further asks why the State is using “dirty tricks and damning evidence in Anthony case” and further asks “how long before they sue everyone”?

    This case is about punishing the only person responsible for taking the life of Caylee Anthony-not about prosecuting the Anthony’s. They may be prosecuted if evidence exists that they lied to the FBI, obstructed justice,or aided and abetted the killer after the fact. We don’t know the extent of the investigation into the alleged wrongdoing of the parents. It is not part of the Felony Murder charge against Ms Anthony.

    The DA does not have to prove the Anthony’s did anything in order to convict Ms Anthony. They will more than likely have to wait in line while Mr Grund, Amy H., Zanny and possibly Mr Kronk take the Anthony’s and their daughter to court for defamation, etc.

    Who cares who Larry King agrees with? Since when is that important? Geraldo Rivera is a lawyer who doesn;t practice law and admits openly that he is a friend of Jose Baez. Jose Baez knows that he is being interviewed by a friend who has access to a national audience. Geraldo is doing what he does best-talking. He can take any point of view he wants and he can give his pal Jose Baez time to promote his clients’ innocence and how he will work to exonerate her. What would you expect him to say?

      Boston, the problem I saw was that Geraldo made the statement, very clearly, I might add, that Casey Anthony is most probably guilty of killing her daughter. I’d think if he was hosting Baez to provide him the opportunity to promote his client’s innocence, Geraldo would refrain from such statements.

    Wow, an admission of fault by Boston, thank you, by the statement that “he (Geraldo) can give his pal Jose Baez time to promote his clients’ innocence and how he will work to exonerate her“. Amazing that Boston now states that Casey is innocent after condemning Casey to death before a trial was even scheduled. Funny how some people just step right into the muck and can’t get out of it. And, Cindy Anthony never admitted to going on national television slandering anyone, if one can actually understand the facts of this case. And, Ostella, yes, I am wearing a Darth Vader costume right now. :)

    All of the Anthony’s, and their friends, and their relatives may all be victims. People not familiar with the case and the facts might see as Caylee being the only victim, but she’s not, at least to educated people.

    I wish Geraldo would shut up. I have suspected for a very long time that he is the one that is financing Casey’s legal fees in exchange for an exclusive. Todd Black/Gil Cabot has/had an office in NYC in the same building that FOX News has offices. Geraldo is just desperate enough to pull something like that.

    Damning evidence? They aren’t leaking depositions. FL law allows them to give the public the depo videos. Ugh…Just shut up already, WHOREaldo.

    Breaking News – BNN received a tip this morning, and news is still coming in, but to put it in the words of Nancy Grace “BOMBSHELL”. We have been able to verify the basic story.

    A small group of people have been trying to maintain a memorial to Caylee Anthony, and systematically the memorial disappears. I believe it was Brad Conway who went on national TV claiming that his clients George and Cindy Anthony had absolutely nothing to do with these events. He may want to re-think this position!

    Last Friday a group of three friends, Lois Peter, her daughter Dakota Peter, and family friend Denise Hill took a small homemade wooden cross to the site and installed it. On Saturday it was gone. They installed a new one, On Sunday they returned and it was once more gone. Yet another cross was put up. The the three friend decided to wait and watch from a distance, to see if they could find out who was removing the memorial. They gave up their vigil at around midnight.

    Last night, Monday, our three musketeers returned to the memorial to ’stake it out’. Interestingly enough on all four nights they drove by the Anthony’s house, and parked outside was the Kidfinders vehicle, in fact there is a rumor (unsubstantiated at this time) that the Milstead’s are in fact staying with the Anthony’s as they have been foreclosed on.

    Our band of Nancy Drew’s actually spotted the Anthony vehicle at the memorial site, and by the time they got back to the Anthony abode George was carrying something into the garage and the memorial was gone.

    It is what happened next that blows this into the ‘BOMBSHELL’ sector. Both the Anthony’s and the Milsteads then got into their vehicles and chased the women through the area. The Anthony’s and Milsteads made at least two attempts to stop the women by blocking cul-d-sac’s with their vehicles.

    At approximately 10:45pm the ladies put out a 911 call. Before anyone could respond they saw a State Troopers vehicle parked and pulled up behind it, the Anthony’s peeled off, but the Milstead’s with ’strobe lights’ flashing also pulled over. As an aside, this part is very believable, Mr. Milstead’s rap sheet does involve a similar incident where he was busted for impersonating a police officer by using flashing strobe lights and pulling someone over.

    Weird turns to weirder, the State Trooper could have cared less, in fact he told them “don’t you think the Anthony’s have been through enough”? He then took the drivers license and walked back to the Milsteads vehicle with it. It is not clear what took place in that discussion, did he show the license to them?

    Again, this is raw data, but you can bet HLN will be on this like white on rice! Jan and I just got off the phone with the ladies, they were en route to the memorial site for an interview with WESH, which should have started about 20 minutes ago.

    We are waiting for the photo’s, we should have an update in a couple of hours.

    Good post on the coverage of Geraldo, ShadowingCrime. Like you I loved the fact that Geraldo just cannot keep his personal opinion to himself. I have now counted 4 times he’s expressed that belief of guilt during coverage of the case. If I were the state I’d quote Geraldo at some point in time LOL.

    Baez and Baden continue to make the “state” the offending party in their quest to seal this tape. Hello, Baez, at the hearing the state and county both stated to the judge that they have no problem to seal the tape.

    The issue at hand is the media’s right to pursue the tape under the Florida Sunshine Law. Rather than spin his wheels focused on the state, his time would be much better spent trying to work on the media heads to give him a break on this one. But no true to form Baez is barking up the wrong tree again. Don’t really know why I’d expect much differently from an attorney who has to refile almost every motion he drafts to get it within the confines of the law.

    Good news is the Sunshine Law has well served “our purpose” for the need to know in this case for sure. As the song goes Baez “Sunshine on my shoulders makes me happy”…………

    I know the State does not do media shows but the only people that Geraldo seems to cater to is Baez and Kinney-Baden. I think it is very one-sided. I find it odd though not having the Anthony’s on there.

    I think it is sick for Larry King to have the Anthony’s on his show again. Larry King never asks the tough questions so it is useless for him to request viewer questions. He caters to them and lets them spin their lies more. If they really cared for Caylee, they would stop the media shows standing behind Casey.

    Our Host/Moderator-I do not find Geraldo Rivera a good judge of character or a good lawyer. It has been many years since he has practiced law and often times when he has no legal analysis he will say something banal or entertaining. I have never found him to be a relaxed or comfortable talk host because he doesn;t always listen to his guests and is constantly “on edge” anticipating a commercial break. He surrounds himself with K Guilfoyle and Janine Piro who agree with him. We know what Jose is going to say before he says it-so does Rivera. In comes the moment of total boredom and Rivera says, “she’s guilty”. He could have said, “I wish you the best in your efforts to support Casey Anthony”. OR (typical Rivera) “Good luck representing the most hater defendant in town”. Even that last stateament would have been better than “she’s guilty’.

I agree Pres Obama has made many changes but his RACE ISNT one of em lol I Use to like Geraldo until he makes everything about Race.. his good friend Jose the Latino Attorney .. ect ect … Now i can’t stand Geraldo .. i guess he thinks MURDERING your kids is ok …

    Hi All!
    Just wondering what your thoughts are now that the autopsy has been released. It states that Caylee was put in the wooded area soon after her death. Do you think this information helps, hurts or makes no difference in Casey’s defense?
    Also, do you think cindy was showing real emotion at the hearing or playing it up for the court?

    I think the autopsy information hurts Casey’s case, given her 31 day script, why would the “real killer” harm Caylee so soon?
    Although I do have empathy for the Anthony’s, especially George, I think Cindy is so full of it. I know she’s hurting, but I also think she fancies herself as somewhat of an actress. Remember her ‘performance’ at the depo? I don’t know why, but Cindy irks the heck out of me everytime I see her.

    With the media onslaught this case has received, I would not doubt that Casey Anthony walks free! The jury will never consider the evidence–they will vote with pure emotion! They will never find a fair and impartial jury–even if they move it out of the United States! The Nancy Graces and Geraldo Riveras of this world have tainted the jury pool with there constant barrage of media reports. I have never seen actual evidence being presented to the media, before being presented in court! Whether you believe in her guilt or innocence, whether you or like of hate Casey, she does not stand a chance in Hell of a fair trial! In our Constitution, you are entitled to that when charged with a crime! This case stinks, and it’s all because the media has already tried and convicted Casey in the court of public opinion! I want justice in this case for the victim, the beautiful Caylee, and yet I feel justice flew right out the window with the media sensationalism. If Casey walks on a technicality, I blame the media. Though we lust for very little tidbit of information on this case, its time to for the evidence to be presented in the courts,not on our television and newspapers every day.

    Fascinating analysis. Those two lawyers really hurt their case by going on that show.

    As far as being convicted in the media—it’s a strange thing. I think Scott Peterson was convicted by media, and many of the media reports about evidence were just plain wrong–the vomit on the mop, smell of bleach in the house, etc. It’s also clear to me that he cooperated with the police to the extent that he continued to take their calls and talk to them even as his lawyer was telling him to stop it. He also went on TV and told the world he loved his wife and wanted to work with her family to find her.

    I know very little about the Anthony case just because I don’t have the stomach to follow these crime stories very closely. The legal aspects of the Peterson case interest me very much, but there’s just too much other important news to follow. HOWEVER–I can’t help but be aware, peripherally, of the Anthony case, and I’m not so sure whether “tried in the media” is applicable, even though it seems like videotape of her has been improperly leaked to media outlets way too many times.
    The thing about this case is that she waited all that time to report her kid missing. Right off the bat that’s just too strange and disturbing. And that’s information that’s going to go out into the public and cause outrage and judgement, sure. But it’s accurate information, apparently, and it’s the type of news that gets its own legs with or without help from the media.
    Also, evidence of remains in her car trunk is pretty incriminating. I mean, if that’s true, it is very hard for me to believe she didn’t know anything and didn’t do it. And that’s regardless of what the media says or does. If they never said a peep about the case I would still remember these two things, which are very incriminating. In particular I can’t think of a situation where a mother would wait a month to report her child missing.
    I have had the impression the media coverage is exploitive and unseemly, from the videotapes of her visiting with her parents and the sound of their conversation being played on the air. Whether or not the police or prosecutors are talking to the press, that’s a leak that should be considered illegal.

    But even without it, it doesn’t look good for Ms. Anthony.
    Just my thoughts.
